Terms of service
1. About these terms
These terms apply when you purchase goods from Rocks Lane Shop at https://rockslane.shop. Please read them before ordering.
Rocks Lane Shop is a trading name of Max Diego Limited, registered in England and Wales under company number 15384533, with its registered office at 35 Cordwallis Road, Maidenhead, Berkshire, United Kingdom, SL6 7BT. In these terms, “we”, “us” and “our” mean Max Diego Limited.
We manage the shop on behalf of Rocks Lane Limited. Your purchase contract is with Max Diego Limited, which receives payment, prepares and fulfils orders, delivers goods, provides customer service and handles returns and refunds. Rocks Lane Limited is not the seller under that contract unless expressly stated otherwise.
You can contact us at info@maxdiego.co.uk.
2. Who may order
You must be at least 18 years old and legally capable of entering into a contract to place an order. Products intended for a child should be ordered by a parent, guardian or other authorised adult.
You are responsible for ensuring that the information supplied with your order is accurate and complete.
3. Products
We take reasonable care to describe and display products accurately. Colours may appear differently depending on a screen or device. Images are illustrative, and minor variations in colour, positioning, finish, packaging or print may occur where they do not materially affect the product.
Please consult the product description and size guide before ordering. Sizing can vary between brands and styles.
4. Placing an order and formation of the contract
The checkout process allows you to review and correct your order before submitting it. An order is an offer by you to buy the selected goods.
An automatic acknowledgement confirms that we have received your order but does not necessarily mean we have accepted it. A binding contract is formed when we send an order acceptance or dispatch confirmation, or when we begin producing a personalised item, whichever occurs first.
We may decline or cancel an order before acceptance, including where an item is unavailable, payment is not authorised, we cannot deliver to the address supplied, there is an obvious pricing or description error, we suspect fraud or misuse, or an order breaches a purchase restriction. If payment has been taken, we will refund it.
5. Prices and payment
Prices are shown in pounds sterling. Prices include VAT where applicable unless stated otherwise. Delivery charges are displayed separately before you confirm the order.
We take reasonable care to ensure prices are correct. If we identify an obvious error before accepting an order, we may contact you to confirm whether you wish to proceed at the correct price or cancel the order and receive a refund.
Payment must be made using a method offered at checkout. Payments are collected for Max Diego Limited through our payment service providers.
6. Availability
All products are subject to availability. Stock records can occasionally be incorrect or an item may become unavailable after an order is placed. If this happens, we will contact you and offer an available alternative where appropriate or refund the unavailable item.
7. Personalisation
Where you submit a name, number, initials, wording or other personalisation, you are responsible for checking it carefully. We may refuse wording or content that is unlawful, infringing, offensive or otherwise inappropriate.
We will reproduce the information submitted, subject to the product description and technical limitations. We are not responsible for a customer-supplied spelling, sizing or selection error. This does not affect your rights where we make an error or the goods are faulty or not as described.
8. Delivery
Our Delivery Policy forms part of these terms. Risk in the goods passes to you when they are delivered to you or to a person you identify to receive them. Ownership passes when we have received payment in full and the goods have been delivered.
9. Cancellation, returns and refunds
Our Returns, Cancellations and Refunds Policy forms part of these terms. It explains the statutory cancellation right for eligible online purchases, our 30-day goodwill return period, the exception for genuinely personalised goods, and your rights where goods are faulty, damaged, incorrect or not as described.
10. Promotions and discount codes
Promotions and codes are subject to their stated terms, availability and expiry dates. Unless expressly allowed, only one code may be used per order, codes cannot be exchanged for cash and cannot be applied retrospectively. We may withdraw a promotion or refuse use where there has been an error, fraud or misuse, without affecting orders already validly accepted.
11. Our responsibility to you
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable.
We supply goods for private and domestic use. If you use them for commercial, business or resale purposes, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity, except where the law does not allow such liability to be excluded.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory rights, or any other liability that cannot lawfully be excluded or limited.
12. Events outside our reasonable control
We are not responsible for delay or failure caused by an event outside our reasonable control. We will contact you as soon as reasonably possible, take steps to minimise the effect and tell you about any material delay. Your statutory rights, including rights relating to late delivery, remain unaffected.
13. Intellectual property
The website and its content, including text, graphics, photographs, product designs, logos and trade marks, belong to us, Rocks Lane Limited or our licensors. You may use the website for personal shopping and information. You must not copy, reproduce, modify, distribute or commercially exploit its content without the relevant owner's permission.
14. Website use and third-party links
You must not misuse the website, introduce malicious code, attempt unauthorised access or interfere with its operation. Links to third-party websites are provided for convenience and do not mean that we control or endorse their content.
15. Changes to these terms
We may update these terms from time to time. The terms in force when your order is accepted will apply to that order, unless a change is required by law and applies retrospectively.
16. Transfer and third-party rights
We may transfer our rights or obligations under the contract to another organisation, but this will not reduce your rights. You may transfer your rights only with our written agreement, except where the law permits otherwise.
The contract is between you and us. No other person has a right to enforce it under the Contracts (Rights of Third Parties) Act 1999.
17. Severability and waiver
If a court finds part of these terms unlawful or unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right does not waive that right.
18. Governing law and disputes
These terms and your contract are governed by the laws of England and Wales. You may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom where you live.
Please contact us at info@maxdiego.co.uk first if you have a complaint so that we can try to resolve it.
